I encountered a pricing issue while purchasing whipping cream.
The Discrepancy:
The unit price label for the whipping cream, visible in the image (bottom left corner), stated a unit price of $0.04 per ounce.
The container was 16 ounces.
Based on the unit price, the calculated price for the container should have been 0.04 \times 16 = \mathbf{\$0.64}.
When I checked out with two containers, I was told the actual price was $6.49 per container.
The Dispute and Texas Law:
I attempted to explain to the cashier and the manager that, according to Texas law, the customer should receive the product at the lowest advertised or marked price, regardless of whether it was the shelf price, sticker price, or unit price.
When the store refused, I searched online and found that Texas law, specifically under weights and measures and statutes related to price fraud, generally supports the consumer receiving the product at the lowest price displayed.
I presented this information to the manager, who dismissed it, stating they would not sell the product to me at $0.64. They also told me not to bother providing the specific legal codes.
So tell me what you think. On Monday, do I go back and try again for my two containers of cream? Or, do I file a complaint the Texas Attorney General and with Texas Weight and Measurements.
I believe, chain stores that gets big enough that all the employees get organized training for their position. Should include this in their training for stockers, cashiers, and up.
