Dear Chief of Police, Ed. Davis, and Chief of Detectives, Franconia District.I am a repeated crime victim along with some estimated 1,000 or more other persons who are, was, or have been crime victims too by these stores, Giant Foods and Safeway stores located in Fairfax County, Franconia District, where I have been revictimized by these named persons, Marianne of Giant and Jorge of Safeway over more than 2 years, 2022 to 2024.Below is my filed Criminal Complaints against each named persons the General District Court clerk told me I have to file with the police dept., these two complaints for the arrests of each named defendant, located at his and her respective store's locations in Kingstowne.Attached, is my copy of the letter from the Virginia State Attorneys General's Office in Maryland and Virginia, whereinVirginia's AG has directed me to file with your department, my criminal felony complaints sincethose defendant's had each committed their illegal acts and misconduct that constitutes the violations under my cited Va. Cr. Codes stated in my complaints.Herein, is my criminal complaint, attached.State Of Virginia, Fairfax County issuing arrest warrants for Managers of Safeway and Giant Foods.County of FairfaxRosario A Fiorani, et al., v. Jorge, Mgr. Safeway, Kingstowne, VA. Land Marianne, Customer Service, Giant Foods, Landover, MD.On and after April 10, 2022, to this date of February 15, 2024, Complaintant, Mr. Rosario A Fiorani has repeatedly tried to obtain his refunds from each of the defendants, Giant Foods and Safeway Store's managers, Mr. Fiorani's entitled cash refunds from his purchases of dozens of defective, tampered with, and hacked gift cards.The total value of those gift cards is about or are more than $3,000 from those two stores located in Kingstowne, Fairfax County, Virginia.Two defendants are managers of Giant Foods and Safeway Stores, respectively, at the time that each defendant did act in or committed their illegal conduct of refusing to, and willfully ignored, refunding Mr. Fiorani his money.Each defendant's acts and/or conduct constitutes the crimes of Embezzlement under Va. Cr. Code, §18.2-111; Grand Larceny, under Va. Cr. Code, §18.2-95; and Fraud, Va. Cr. Code, §18.2-178, Theft by Deception, §18.2-178.Whereon, about, and after June 7, 2023, to February 15, 2024, Mr. Fiorani arrived at each defendant's store asking for the Store's defendant, manager, to re-ask for his refund(s) after each defendant's manager made false representations to Mr. Fiorani that he and/or she will get in contact with Mr. Fiorani in a few days.After about 7-10 days, between January 10, 2024, and February 15, 2024, Mr. Fiorani recontacted the defendant store's managers respectfully asking, demanding his entitled refund(s) from the purchases of those gift cards, valued at about or more than $3,000.As relevant to each crime, each defendant manager repeatedly denied, ignored his refunds, and each defendant made many false representations on his or her unlawfully withholding his refund, refusing to return to Mr. Fiorani, those clearly-verified losses from the purchases of defective, tampered with or hacked gift cards sold by this store, per the store's receipts.Whereby, each defendant store manager, by his or her illegal acts and conduct, committed between those respective dates, cited above, constitutes their crimes of fraud, theft by deception, grand larceny, and embezzlement, since those refunds are withheld by each defendant, store manager, does not belong to the store, but is in the sole possession, under the immediate control of that store'snamed defendant, manager, as defined and outlined in the criminal code sections.Complaintant,Rosario "Ross" A Fiorani, Jr.
