Formal Complaint Regarding Racial Profiling and Mistreatment at Store#: 08081Dear Five Below Corporate Office,I am writing to formally report an incident of racial profiling and mistreatment that I experienced at Store#: 08081 on Wednesday, January 10, 2024, around 10:15 am. During my visit to the store, I was subjected to discriminatory behavior by an employee named Markisha, which has prompted me to take further action.Upon entering the store, I was seeking to purchase a Coffee Tumblr and some headphones. I was initially assisted by a courteous employee who directed me to the items I was looking for. However, when I inquired about the return policy for a pair of headphones that appeared to be repackaged, the employee was unsure and referred me to Markisha.Upon approaching Markisha and politely asking about the return policy, I was met with dismissive and disrespectful behavior. Despite my attempts to maintain a respectful demeanor, Markisha proceeded to question my manners and insinuated that I did not greet her properly. It is important to note that I was recovering from a cold and wearing a face mask, which may have affected the clarity of my speech.I strongly believe that Markisha's behavior was motivated by racial bias, as she seemed to assume that I did not speak English and sought to assert her authority over me; based on my Hispanic appearance. As someone who values and practices respectful customer service, I found her conduct deeply troubling and unacceptable.To give you some background, I am 32 years old, male and Hispanic descent. I was wearing sweatpants, a jacket, a face mask and a beanie hat. This was my conversation with Markisha:As Markisha walks to the front of the store, I proceeded to say:Anthony (Me) – “Hi, may I ask you the return policy for this item?”Markisha – Doesn’t acknowledge me and gets closer and closer and says: “hello, hello, hello……. Manners?!”Anthony (me) – “I did say hello and you probably didn’t hear me because of the mask that I am wearing, and you don’t need to treat me like this, manners?” – (mind you, I am just getting my voice back as I am recovering from a cold that I had, but Markisha doesn’t know this as she doesn’t know me) – I walked away from her and didn’t care to argue with herMarkisha says: “No, you didn’t.”Regardless of manners or not, employees can’t go around telling people about their manners or not. Not only that, but she wants to be right about the words that are coming out of my mouth.The whole time I was respectful, and I was only asking questions about items of the store she is working at.It is my sincere hope that this matter will be thoroughly investigated to prevent similar incidents from occurring in the future. Racial profiling and discrimination have no place in our society, and it is essential that all individuals are treated with dignity and respect, regardless of their background.I am considering escalating this issue to government entities, such as the Human Rights Commission, to ensure that appropriate action is taken to address and prevent such discriminatory behavior. I urge Five Below to take this matter seriously and implement measures to prevent racial profiling and mistreatment within its stores.Thank you for your attention to this important issue. They racially profiled me. A young lady who was maybe asian was in line before me and she was able to scan her items with no “help” from the attendant. When I got to the self checkout register, the attendant (scheduled to work on June 11, 2023) walked over to me and asked if I needed help. I looked her dead in the eyes like are you kidding me? Then I firmly told her no thank you except I needed some bags. She informed me that they only have the reusable bags for .35 each, I said cool, Ill take two of them as I looked around wondering where they were. She kept watching me and told me that they were in the middle of the store. She kept watching my cart, me and items that I was scanning as if she was afraid to step away to get the bags for me to purchase. She finally ran off very quickly and kept looking back at me as she ran away and back to the register. She then came over to me and scanned my reusable bags and checked my cart and looked on the screen to make sure that everything that was on the counter was on the screen. At this point I felt as if I was being accused of stealing without being verbally accused of stealing. I mean her actions said it all!! As a former trainer of CVS employees, I understand the procedures that are to be followed for loss prevention, but damn! I really felt bad after leaving just because I am a woman of color I have to be watched closely. This was a sad moment for me because I am a woman of color with INTEGRITY. For example, If I walk out of a store and realize I didn’t pay for it, I will take it back and let them know do that I can pay for the item. I know they don’t know this about me but it’s sad because I know this about me.Dear 5 below, You need to update your loss prevention training program to keep an eye on ALL people because while you all are watching the people of color, the others that you do not think would steal from you DEFINITELY WILL especially because they know you don’t watch them.Ohhh and not all people of color steal. We are also hard working, law abiding citizens with integrity!!!

The store is clean and well kept and I even had an associate ask me if I needed help with anything. This is something that I never see at other locations.

This store is as good as any five below stores. However, it is a first to ser self checkout, which saves time. Many new collections in this one.

The ladies that work there are great! The store is constantly a mess tho thanks to the customers who are disrespectful and quite frankly gross. They just tear open packages and leave them ripped open on the shelves. They let their little brats run around making a mess and stealing. The ADULTS also constantly steal. I think corporate needs to raise the employees that work here's wages. It's not worth it. People in jail aren't even this trifling. Or they need to give them their own security officer...Twice I've witnessed a customer threatening, yelling, and cussing out one of the employees because they didn't want to leave when the store was closing. I've incuded pictures of what it looks like when one of the manager ladies finishes cleaning up and making everything look nice at the end of the night... and also pictures of what it looks like not but 45 minutes after school lets out... The people that shop there need to just stay home. I don't know where in the world you can act like this and it's acceptable, but wherever that is, they need to GO BACK.

If I could rate a zero I would. We went to checkout and two of the items we had didn't have a price on them. The first rang up far more expensive than we expected so we deleted it, then another item rang up with the wrong price so we also deleted that one, but the second deletion triggered that employee assistance was needed. There's no light, no ping on the overheard speakers, absolutely no way that we can tell that an employee has been notified. In fact there's no employee anywhere to be seen. We wait. No one. So we abandon that checkout and move to the next one. Same thing happens, where a second deletion due to a price discrepancy causes the need for employee assistance. Still no one to be found. So we move to a third checkout and just abandon all the items with incorrect/unmarked pricing. As soon as we got into our car we magically see an employee up front for about three second before he disappears again. He didn't even notice that we had left merchandise at two of the checkouts. That will be our last visit to Five Below.
